Jammeh’s last ditch attempt to Subvert the Will of Gambian People through The National Assembly
On 9th December 2016 Yaya Jammeh appeared on state TV to not just reject the election results but to annul it and declare that he will organise fresh elections at a later date with a new Election Commission. This was effectively the start of a month and a half of sheer hell and emotional rollercoaster for every Gambian yearning for change. The Coalition responded with a simple statement asking Gambians to remain calm and reminded Yaya Jammeh that he has no right according to the Gambian Constitution to annul the results. This heralded the beginning of Jammeh’s constitutional nightmare as he was forced to now turn to a non existent Supreme Court that he failed to constitute because he had no respect for the constitutional rights of Gambians seeking redress at the Supreme Court. The Whole world expressed their support for the choice of the Gambian people, further adding to Jammeh’s isolation and legal woes. The only judge currently sitting at the Supreme Court Chief Justice Emmanuel Fagbenle informed Jammeh on 11th January 2016 that he is unable hear his supreme court case as there are no judges currently available from Nigeria until May 2017, this effectively ended Jammeh’s hopes of subverting the will of the Gambian people through the highly compromised courts. Jammeh’s other attempt at subverting the will of the people through a desperate injunction that would effectively prevent literally the entire country from the Chief Justice, National Assembly, government institutions and including Jammeh himself from participating in any shape or form in the 19th January 2017 inauguration of President Elect Barrow, looks likely to go the same way as his election petition. With only one Supreme Court judge in the Gambia the Nigerian Chief Justice Emmanuel Fagbenle also petitioned in the injuction, it looks like that case would also be another non starter as we would be surprised if Fagbenle hears a case where he is also petitioned and being prevented from participating in the inauguration.
Jammeh’s desperate attempts through his executive pronouncement on 9th December 2016 and Supreme Court cases to subvert the will of the people having effectively failed, has not prevented Jammeh and his inner circle from plotting ways of staying in power. The plot to assassinate the President Elect was also preempted with the President Elect safely evacuated out of the country, further adding to Jammeh’s desperation. Readers will recall that Jammeh refused to provide the President elect with any Security since his election by the people on 2nd December 2016. Jammeh has since employed a constititional lawyer from Nigeria to help him use the constitution he has never respected to him stay in power. The Constitutional Lawyer from Nigeria is now expected through the Gambian National Assembly where Jammeh controls to propose a set of laws meant to extend Jammeh’s term as President. The Gambia Bar Association has already issued a statement warning National Assembly members that any laws enacted to subvert the will of the people and the constitution is an act of treason.
As Karamba Touray articulated “The National Assembly of The Gambia throughout its torrid and destructive history over the last 22 years has never put the Supreme national interest of our people above the insatiable whims of the dictator they value more than themselves . We the people whose liberties they seized , whose abuse they codified into law and whose resources they squandered condemn them for their shameful record. Any motion they pass in this just called extraordinary session of theirs in the dying days of the tyranny they gave support and succor to is null and void whatever the motivation. They cannot subvert the supremacy of the constitution of the Republic of The Gambia by treachery . Whatever they pass in this hurried session they are trying to convene won’t be worth the paper it is written even if it were a comprehensive apology for being appendages of tyranny for twenty two years. Their offense of the Gambian people carried out with profound glee is a pain we can endure. But trying to craft and execute treason in a bid to help a doomed dictator would constitute an unforgivable crime. We demand all National Assembly members return to their homes and never attempt any legislative business until constitutional democracy is restored on the 19 th January 2017.”
in an unprecedented move, we are thus publishing here under the phone numbers of all the National Assembly members for concerned Gambians to call them and demand that they stand with their constituents and defend the will of the Gambian people to end dictatorship in Gambia. Please call and insist they not respond to the calls over state media for them to report to the National Assembly to help Jammeh and his Nigerian constitutional lawyer to subvert the will of the people. We understand that no National member was formally informed, they received the information via state TV.
