Now that the UK is out of the European Union, what does this mean to the European citizens and their families living in the UK?
From the legal point of view, laws are meant to be prospective, that means anyone legally here in the UK from Europe and their family members will not normally be affected.
However, if UK implements the Australian type of the point base system, there can’t be nothing wrong or any legal huddle stopping them from enacting legislation requiring all those in country to meet the requirements of that legislation.
That may mean going out and reapply under the new point base system or requiring employers to impose the new requirements on both their existing and prospective employees.
Implications are that thousands of Europeans and their family members may be ask to leave the UK or risk been removed from the UK.
As an Immigration lawyer actively and a seasoned practitioner of Immigration law, I can candidly say that the UK Visas or commonly known as Home Office has hatched a cruel plan against especially the family members of EU citizens and their family members especially the non-European family members by unreasonably delaying and refusing their applications on very flimsy and unreasonable grounds.
All that was done to frustrate their legal status with the expectation that UK will leave the EU and can be easily asked to leave with their spouses back to their respective EU countries to reapply under the new point base system.
How many of them will meet the new requirements?
It is scary and it is going to affect millions of European citizens living in and working in the UK and their family members.
In the light of all these the need for a sound legal advice is imperative and as it will involve the lives and status of lots of people and their family members, one needs to act quick before any surprises knock on one’s door.
Will keep updating on the new Expected Immigration rules that will very soon surface from the dreaded Home Office.
It is now apparent that the British Public has chosen their faith by leaving the European Union.
In the coming weeks, Article 50 may now be triggered and negotiations will begin. We are unsure for now who will benefit what and who will be affected. These negotiations can go on for 2 years until a final resolution is achieved.
It will be unwise not to have any application with the Home Office should your status remains unresolved.
There are RUMOURS that Amnesty may be considered by the incoming government.
